Booking and Reservation:
Clients must provide a non-refundable deposit to secure the catering service for their event. The deposit amount and payment schedule should be clearly outlined in the agreement. The final balance must be paid by a specified date prior to the event.
Cancellation and Refund Policy:
Cancellations made within a certain timeframe may result in forfeiture of the deposit. Any cancellations made after a specified date may result in the client being liable for the full balance. Refunds may be provided under certain circumstances, such as force majeure events or unforeseen emergencies.
Menu and Guest Count:
The client must provide final menu selections and guest count by a specified date prior to the event. Any changes to the menu or guest count after this date may incur additional charges. The catering service reserves the right to make substitutions to the menu items based on availability.
Service Details:
The catering service will provide a specified number of serving staff based on the size and scope of the event. Setup and cleanup services will be provided as agreed upon, including any necessary equipment and utensils. Any additional services requested by the client, such as bartending or rentals, will be subject to additional charges.
Liability and Insurance:
The catering service should maintain appropriate liability insurance coverage. The client should also maintain event liability insurance to cover any damages or injuries that may occur during the event. Both parties should indemnify and hold harmless each other from any claims arising out of the catering services.
Force Majeure:
The catering service is not liable for any delays or failures in performance due to circumstances beyond their control, such as natural disasters, strikes, or government regulations. In such cases, the catering service will make reasonable efforts to mitigate the impact on the event.
Client Responsibilities:
The client is responsible for providing necessary permits, licenses, and approvals for the event venue. The client should inform the catering service of any special dietary requirements, allergies, or restrictions of the guests.
Intellectual Property:
The catering service retains all rights to their intellectual property, including recipes, menus, and branding. The client may not reproduce or distribute any materials provided by the catering service without prior consent.
Governing Law and Dispute Resolution:
The agreement is governed by the laws of [jurisdiction], and any disputes shall be resolved through arbitration or mediation.
Miscellaneous:
The terms and conditions are subject to change at the discretion of the catering service. The agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations.
